The Mombasa High Court on Monday declined to unfreeze the bank accounts of two human rights lobby groups which were blocked after they were accused of allegedly funding terrorist activities.

The two Mombasa-based lobby groups, Haki Africa and Muslims for Human Rights had filed an application before the court seeking conservatory orders to have the freeze on their bank accounts order lifted.

In his ruling, Judge Matthew Anyara Emukhule declined their application saying the court has not heard all arguments by the parties in the case.

The Judge said he could not unfreeze the bank accounts as requested by the two organizations because not all parties had argued the petition fully.

The respondents in the case had however filed an application before the court to have the case adjourned saying they need more time to write their responses.

The respondents in the case are the Inspector General of Police, the Interior Cabinet Secretary, the Attorney General, the Director of Public Prosecutions, the Financial Reporting Centre and the Central Bank of Kenya.

The two groups through their lawyers however had argued that the respondents are frustrating expeditious hearing and denying petitioners their rights.

The two organizations had argued that the freezing of their accounts was unconstitutional and done out of malice.

The lobby groups further said that adjournment of the case would cause hardship to their employees and their families.

Judge Emukhule allowed the application by the respondents and adjourned the case but gave them 14 days to file and serve their submissions.

The case will continue on October 2.
