Kikuyu Chief Magistrate sentenced an elderly man on Thursday to life imprisonment for defilement charged. 60 year old Fanuel Njenga defiled a ten year old girl in Gitaru village of Kikuyu Sub County on the 15th January 2015.
He is accused of grabbing the girl who was passing near his farm as he was repairing his fence. He defiled her and later threatened to kill her if she mentions anything to anyone. The girl then went home in pain and told her mother of the incident and the girl's mother took her to Kikuyu hospital after she noticed she was bleeding.
The prosecution witness Grace Wamaitha said that the girl's mother reported the matter to her, who is the sister to the accused person but referred them to Kabete police station. She told the court that his brother tried to convince her to talk to the girl's daughter so that they may settle the matter out of court.
However she refused and told him to go and tell them himself. The girl's mother Nancy Njeri said that Njenga visited his house four times trying to persuade them not to take the matter to the police. However she said that she preferred to settle the matter before a court of law.
Another prosecution witness, Dr Joseph Kimindi from Kikuyu Hospital testified that he had taken tests on the girl on the 15 January 2015 when her mother brought her after she was bleeding. He stated that the results of the tests proves that the girl was defiled and even suffered injuries that caused the bleeding. Chief Magistrate, James Ogweno said that he had proven the case beyond reasonable doubt that Njenga was guilty of the charges. "I have listened to both sides of the case and its beyond reasonable doubt that the accused person is guilty of the charges. I sentence you to life imprisonment," said the Magistrate.
