A Mombasa businessman linked to a Sh44 million ivory haul seized in Mombasa was released on bond following adjournment of the case. Mombasa Principal Magistrate Davis Karani released Mr Feisal Mohamed Ali alias Feisal Shahbal on a Sh10 million bond.
Assistant Director of Public Prosecutions (DPP) Alexander Muteti during the Friday hearing filed an application to have the case adjourned.
Mr Mohamed is being charged alongside Ghalib Sadiq Kara, Abdul Halim Sadiq, Pravez Noor Mohamed and Abdulmajeed Ibrahim.
The accused persons were being accused of allegedly being in possession of 2,152 kgs of ivory on June 5 in Tudor, Mombasa County.
They however denied the charges and through their lawyers asked the court to release them on bail pending the case hearing.
The lawyers argued that Mr Mohamed was sick and he should be released on bail to seek medical attention.
Assistant DPP Muteti however opposed the bail application saying Mr Mohamed’s health condition was not that bad to warrant his release and Shimo la Tewa Prison where he was being held has adequate health facilities.
Mr Muteti asked the court to grant him two weeks to gather more information in the case. Magistrate Karani while releasing them on bond said there was no compelling reason to have the accused remanded.
The magistrate said, “I have given the DPP seven days to gather all the evidence they need in the case. The accused person will be released on bond.”
The case will be heard on September 11.
