The body of a man who died two months ago is still lying at Kisii Level Five Hospital Mortuary awaiting the resolution of a land dispute in Bonchari Sub County.
The late Cyrus Mogoi had been living with his family in a disputed land in Bomokora ward since he was born. However, after his demise he could not be buried due to the land tussle pitting two families in the area.
According to the deceased’s elder brother Mr Erick Mogoi, the land they are living in was bought by their father before he passed away and the owner of the land is now saying the land was leased to them for 60 years which are almost ending.
Elders who stopped the burial said the deceased could not be buried on the disputed land arguing that it had not been demarcated to ascertain ownership.
The elder of the area Mr Agora Oirere insisted that the land belonged to the old man identified as Stanley Ongaga and they witnessed when he was leasing it to the family. He said the man did not sell the land to Mogoi’s family as they claim.
He said the case over the piece of land was pending in court over a long time as the owners of the land have not been able to attend any court proceedings.
The wife to the deceased Ms Regina Mogoi and her sons said they were worried that the body of their departed kin may take a much longer time in the mortuary because for the two months the case has not been concluded.
The family of the late Cyrus Mogoi will be forced to wait much longer before the law society of Kenya gives direction on the next course of action.
Meanwhile, the mortuary bills continue to accumulate leaving the family in more financial crisis.
