A 55-year-old man was on Friday jailed by a Kiambu court for sending a threatening message to his brother over land ownership dispute.

Michael Njoroge appeared before Principal Magistrate Diana Mochache and pleaded guilty to the charges. He was jailed for three months.

The prosecution told the court that on July 9, 2015 in Ting'ang'a, Njoroge sent his brother a death threat message that said "Ntakuua kama hutatoka kwa hiyo shamba,wewe ni mdogo wangu" due to a land dispute that involved the two.

Njoroge sent the message after his younger brother came back from Dubai two weeks ago after being there for the past three years. The younger brother, Martin Gachimu, had travelled to Dubai and when he left he asked his brother Njoroge to take care of his land until he is back.

However, when Gachimu came back, he found that the brother had taken over the land and claimed ownership since the younger brother had not been home for the three years.

When he tried asking, Njoroge became angry and didn't want to talk about it but kept telling him the piece of land is his. On that day in the evening, Njoroge sent the message to his brother. Gachimu reported the issue at Ting'ang'a Police Post and investigations were launched.

In mitigation, Njoroge said that he had apologised to his brother. He pleaded that the court will forgive him for the offence.

However the magistrate gave Njoroge the option of paying a Sh50,000 fine.
