A 32 year old man from Mang’u in Kiambu County will languish in prison for the rest of his life after he was found guilty of defiling an 5-year old girl by a Thika court.

Martin Mugo was convicted by the Thika resident magistrate Esther W Mburu of defiling the minor on September 26, 2015 at Gatimu village in Mangu location at 9:00 pm.

The packed court was told by the prosecutor that the accused sent the girl to his house ostensibly on the fateful day to fetch for him a rope but followed and defiled her.

The girl’s brother is said to have become suspicious and followed the accused and witnessed the traumatising act visited on his sister by peeping through the door.

He then raised the alarm and members of the public apprehended the suspect and handled him to Mang’u police officers who arrested the accused and later opened a case file against the heinous acts he committed.

In mitigation, Mugo pleaded with the court to be lenient saying he was the sole bread winner of his family.

"I ask the court to forgive me or if possible give me a simple punishment, I will never do that again. I am the bread winner of my family and if I’ll be given a harsh penalty, they will toil," he said.

But the magistrate after considering the circumstances of the offence said he did not have an option but to prefer the prescribed sentence according to the law. He was handed a life imprisonment.

The accused was given 14 days to appeal against the sentence.
