A man who crashed on an extruder machine and lost his left middle finger has sued his employer for negligence in a Nakuru court.
Joel Oyieri Nyamwangi on Thursday told Principal Magistrate Victor Wakumile that the management of Kapi Limited Nakuru was to blame for the misfortune that befell him on the night of March 27, 2013.
He insisted that his supervisor made him clean the machine while its engine was still running which caused the accident.
"Despite telling them that the machine needed to be turned off while being washed they simply dismissed me," he stated.
Nyamwangi added that on, the fateful night, he slid from the machine's staircase and crashed down so badly that his left hand landed squarely on the machine's sharp clogs resulting in the cut.
He further blamed the company for abandoning him and forcing him to foot his own medical bills. Nyamwangi is now demanding for compensation.
However, Kapi Limited in their defense said the employee was too negligent and didn't use both hand gloves and gumboots which were always at his disposal while at work.
