The defilement case against Njoro Girls High School teacher will now be heard before Senior Principle magistrate Maroro Nyakundi after it was allocated to her by a Nakuru court.
The case has so far seen Chief Magistrate Doreen Mulekyo withdraw herself from handling it and another principle magistrate sacked following judicial sackings.
On September 24, Senior Resident Magistrate Judicaster Nthuku directed that the case be mentioned on October 12, before a plea court for directions on court allocation and fixing of a hearing date.
On Monday, Senior Principle magistrate Liz Gicheha ordered that the case will be heard by Nyakundi on December 8.
Paul Gicheri, 52, a Kiswahili teacher at the school is accused of defiling a 15-year-old girl. He also faces five counts of sexually abusing other girls from the same school.
He allegedly altered marks of the students for sex.
He is represented by lawyers Karanja Mbugua and Olaly Cheche who were satisfied with the move to allocate the case to another court.
Chief Magistrate Doreen Mulekyo who initially took the case at plea level and having heard one minor testify before her, disqualified herself from hearing the case in August on the grounds that the conduct by the prosecution had made it hard to maintain her objectivity.
Mulekyo said she was disgusted and disappointed by the way the prosecution kept amending and substituting the charge sheet which did not provide a way forward to the court.
Senior Principle Magistrate Bernard Ndenda took over the case and was ready to proceed but was sacked by the Judges and Magistrates Vetting Board over alleged financial impropriety and poor writing skills.
Gicheri was released Sh200, 000 cash bail and told to report to OCS at the Njoro Police Station every Friday.
