A Nakuru High Court on Tuesday extended orders restraining a government agency from shutting down the medical laboratory of a private hospital.

The hospital is accused of failing to meet set requirements and closure has been suspended until the ruling on the matter is made.

The orders barred the Kenya Medical Laboratory Technicians and Technologists (KMLTT) from closing down Valley Hospital by revoking its license and attempting to shut down its medical laboratory.

Justice Maureen Odero slated the ruling of the matter on  January 26, 2016 after having given both parties 14 days to file and serve written submissions on the matter.

KMLTT is said to have irregularly closed down Valley Hospital Limited medical laboratory without prior notice indicating reasons for its closure.

The hospital protested the move by the government agency on  October 14 after they visited the premises and chased away everybody including patients in the lab before shutting it down.

Upon inspection of the lab, KMLTT is said to have made a report of inspection and left an invoice of Sh462,000 being money for application fee, inspection fee, registration fee and annual license fee.

However, the hospital claims to have paid registration among other fee and was issued with certificate of registration to operate as a private medical institution in accordance with the rule of medical practitioners and Dentists.

In their affidavit, the Hospital through their lawyer Kip Koech Ng’etich indicated that they had already been granted the license to operate for the year 2015 and also issued with registration of a work place by director of Occupational safety and Health Services for August 2015 to August 2016.
