Four people were arraigned before a Nakuru court on Tuesday for allegedly obtaining money fraudulently in sale of a piece of land.

Lucy Nyambura, William Kiptanui, Mary Wamboi and Chepkirui were accused of allegedly obtaining Sh550,000 from John Mathenge as payment of a piece of land in Ngata farm on December 1, 2015 within Nakuru Township.

According to the prosecution file, the complainant and the accused had agreed on a payment of the land which he paid the said amount.

Accused representative Ochang Ajigo pleaded with the court that it may be lenient and reasonable in giving bond terms saying that the accused have families who depend on them for survival.

“The first accused has minor children with no one to take care of them at home while she is in custody, the third accused is a grandmother to small children who were left to her by parent who died recently,” he pleaded.

Ochang also urged the court to order the investigative officer to return the money and mobile phone of second accused, Kiptanui whose property were confiscated by the officers on Sunday when he was arrested.

Appearing before Chief Magistrate Doreen Mulekyo, the accused pleaded not guilty and were released on a surety bond of Sh100,000 with a similar amount as cash bail.

Mulekyo also ordered the prosecution to respond to claims by the defense that the phones and money of the accused were taken by the officer.

The case will be mentioned on January 26, 2016 and heard on March 1, 2016.
