A suspected heroine trafficker was on Tuesday charged before a Kisumu court.
Paul Sitili pleaded not guilty before chief magistrate Thomas Obutu over charges of trafficking heroine worth Sh300,000.
The case had been delayed for a two weeks because of incomplete investigations and poor health condition of the suspect.
Sitili suffers from tuberculosis and during his arrest, he was too weak to commence the case.
The prosecution had also applied for postponement of the case as other suspects were still at large.
The prosecution, however, did not present a report from the doctor indicating the health status of Sitili as ordered previously.
“Having failed to present medical report before this court, I therefore give the prosecution 24 hours to bring the report before my desk,” ruled Obutu.
“The accused has been uncooperative with doctors, though he has TB, doctors are unable to establish what is the progress, sometimes he completely fails to talk,” said Amos Okundi on behalf of the prosecution.
Sitili however, claimed he has been denied basic needs while in custody and it was one reason he wanted the court to grant him bail.
He said that his health condition would worsen if he continues to languish in prison.
