Machakos county traders have stated their intention to file a case against the county government over defiling a court ruling.

The chairman of Machakos traders Simon Kitheka on Tuesday said that the county government officers are still forcing collection of the new high taxes. 

"The machines that the council officers are using have been set to accept the new set taxes that have been stopped by the magistrate courts which is breaking the law and our rights as per the constitution of Kenya," said Kitheka.

The chairman was speaking during a meeting in Machakos Mulu Mutisya gardens. 

Among the officials present in the meeting was the Ndalani member of county assembly (MCA) Stephen Muthuka, Cornelius Kitheka, MCA Machakos Central Kyalo Kyuli, MCA Wamunyu and Dominic Maitha from Muthwani. 

The former Secretary of KNUT Albanus Mutisya was also present and supported the fact that law tax increase on traders shouldn't be increased by more than 6% at once. 

"The law of the land says that if there is an increase on business, payment to the government should not be by more than 6 percent. In fact you should argue that if there is any increase it shouldn't be by more than that," he added.

The Machakos traders after the meeting, agreed to defer the new payment and instead pay the old 2015 tax amount. 

The court recently ordered a halt of the new payments up to March 17, 2016 when the case will be determined.
