Biashara ward MCA who was arraigned before a Nakuru court Friday failed to take plea after the court declared the charge sheet defective.

Stephen Muiruri Kuria was to plead on charges of incitement to violence, alleged to have been made on June 20, 2015 at KANU house within Nakuru Township.

According to the charge sheet, Mwiruri uttered words that indicated or implied that it was desirable that the court ordered useless as he continued to incite members of the public to destroy modern stalls that were under construction in the township.

It’s alleged that he said; “this court order is just a piece of paper which I will tear into pieces” as he went ahead and pulled down the stalls.

Mwiruri was arrested and given a police bond.

Appearing before Chief Magistrate Doreen Mulekyo, Mwiruri could not take plea as the court declared the charge sheet defective.

The prosecution through State Counsel Sandra Kosgei urged the court to give him time to amend the charge sheet so as to charge the MCA.

Mwiruri’s lawyer Ochang Ajigo urged the court to make an order that his client’s cash bail by the police be returned to him.

The court discharged him under section 89 (5) of the criminal procedure code.

The court said that was up to the prosecution to amend the charges and decide whether to charge the accused.
