National Environment and Management Authority (Nema) has asked for more time to consult over the negotiation process with Nakuru East MP David Gikaria in a case he is accused of dumping liquid and solid waste on a public highway.
The matter came up for directions on Monday after Nema prosecutor Moses Mburu denied having any instructions on the matter which was to be withdrawn from court following an out-of-court settlement between the government agency and the MP.
MP Gikaria is been accused of allegedly disposing of solid and liquid waste on different occasions July 11 and July 16, along the Nakuru-Eldoret road.
Principal magistrate Wakumile Ndururu slated the mention of the matter to December 9 upon which Nema will have made their decision on whether to pursue the matter legally.
On November 2, senior resident Magistrate Judicaster Nthuku had extended the time for negotiations after both parties insisted that they were still in the process.
Gikaria is said to have led a team of public along the Geoffrey Kamau road to dispose the waste in areas that are not approved by the National Environment and Management Authority.
This had come in the wake of the presidential directive that MPs flash out illicit brews from their respective counties by all means possible.
The accused had refused to take plea insisting that he was following the president’s order but the magistrate had insisted that all the accused need to know is the charges leveled against him and the rest was not of concern to the court.
The court thus entered a plea of not guilty where it granted the accused a personal bond of sh 300,000 or a cash bail of Sh200,000.
