The Supreme Court judge Philip Tunoi now has a case to answer after President Uhuru Kenyatta declined forming the tribunal.

According to reports from Statehouse, the president refused to form a tribunal for Tunoi saying he will only do that after the case filed at the court of appeal challenging his retirement is heard and determined.

President Kenyatta in his letter to the chief Justice Willy Mutunga proposed that they wait for the outcome of the judicial process after which they shall process the petition as required by the constitution and the law.

He said the court’s decision on ruling on the retirement age of Tunoi was crucial before forming a tribunal to probe if the judge received sh200 million from Nairobi governor, Evans Kidero to favour him and continue ruling as the city’s governor.

On his side, the president said Tunoi has already been declared by a court of competent jurisdiction to have retired from office after attaining 70 years of age.
