The ongoing fierce debate about readmission of recanted evidence at the International Criminal Court in the cases facing Deputy President William Ruto and journalist Joshua Sang has also attracted attention of some senior lawyers.
The two are fighting the recent decision by the Hague based court to admit use of recanted evidence in their case.
Senior Counsel Okongo Mogeni and George Kegoro on Tuesday warned politicians against politicking about the issue and urged the parties concerned to embrace a ceasefire on the matter.
“It is really disappointing that politicians are using public forums to discuss a matter that is before an international court. A court case should be avoided in public discussions and I think the DP and his team are missing the point,” Mogeni said when he visited Orange Democratic Movement offices in Nyamira.
He said the continued pressure on ICC by the Kenyan politicians was likely to have insignificant impact in the cases and predicted of severe consequences.
“Court systems have a unique way of operation. Hiding in politics to abuse the court process will worsen matters. Judgments are done based on evidence produced and defense teams should be concerned with producing counter evidence to disapprove the prosecution,” Mogeni added.
Kegoro urged politicians to give the defense team of the accused person’s humble time to face the matter head-on without necessary lynching ICC in the public.
“I have been in practice for a long time and i think they (politicians) are losing bearing. This is the opportune time for defense team to gather counter evidence instead of rallying against application of rule 68. They are worsening the case,” Kegoro said.
