A Kisumu law court on Monday acquitted a robbery with violence suspect over lack of evidence.
Solomon Okello was set free by Kisumu Principal Magistrate Thomas Obutu for the offence he allegedly committed in July 24.
He had been accused of breaking into the house of Miriam Akoth a resident of Milimani Kisumu and making away with property worth Sh100,000.
In his acquittal statement, Mr Obutu said the prosecution had alleged that the accused was in Kisumu at the time of the crime, but the defense lawyers proved before the court that the accused person was in Kakamega.
"On the charge of handling stolen property, in this matter a mobile phone, the accused bought the alleged phone from an electronic shop where he has produced the necessary documentation proving that he was not aware the phone was stolen," said Obutu.
Obutu further said that the prosecution had done a shoddy job investigating the matter.
"It is clear that the investigations carried by the prosecution was shoddy, I urge the prosecution to carry out fresh investigations and find the real culprits, I therefore acquit the accused," said Obutu.
The case which has been ongoing for five months saw Mr Okello deny the charges labelled against him.
