According to the prosecution, the accused received the alleged amount from Samson Ochieng, a trader in Kisumu Town, with a promise of supplying him with a wide range of Iranian carpets.
The court heard that Ochieng gave Maina the in cash on the said date and he was to supply the carpets in a weeks’ time.
When the given time elapsed, Omondi was nowhere to be found as his phone went unanswered. This prompted Ochieng to file a report with the police who launched investigations into the matter.
Omondi was arrested on August 20 at his Milimani home in Kisumu. He claimed that the money he received was not for buying carpets but paying an old debt.
Maina released him on a cash bail of Sh100, 000 with a surety of a similar amount pending the hearing of the case on January 13, next year.
