A case in which Bahati MP Kimani Ngunjiri is accused of assaulting a police officer has been postponed to October.

The matter was to be heard on Monday at a Nakuru court but was postponed after the MP’s lawyer pleaded with the court to hear it at a later date.

Lawyer David Mongeri told senior principal magistrate Felix Kombo that he was yet to get files related to the case from another court.

“I need more time to obtain the files of the charges my client was acquitted of, which will be part of the defence before this court,” he said.

The magistrate allowed the application and fixed the next hearing date for October 21.

He, however, turned down an application by the case prosecutor seeking to have one of the witnesses testify in private.

Inspector Seroney Rop said the witness needs to tender evidence in a secluded chamber “because of fear of the wrath from the TNA legislator’s supporters”.

Mongeri opposed the application, saying the prosecution was sensationalising the matter.

While dismissing the application, Mr Kombo said no threats had been issued to any of the witnesses to warrant the move.

Ngunjiri faces three counts of contravening the National Police Service Act. He is accused of obstructing Inspector Maria Mutheu from executing her duties on August 15 last year along Nakuru’s Kenyatta Avenue.

The lawmaker is further accused of resisting arrest and causing bodily harm to the officer, charges he denied before being released on a Sh500,000 bond.

The TNA MP was in December last year acquitted of three traffic offences he was facing by resident  magistrate Rita Amwayi.
