A Nakuru court has reinstated a sacked secondary school teacher accused of failing to comply to an order by the Teachers Service Commission (TSC) to report to a new workstation.   Catherin Watoro, a teacher at Nakuru Day secondary school sued TSC on January 2 this year for wrongful termination of her employment. She went to court to have her employer compelled to pay her damages for the wrongful dismissal. 

Justice Byrum Ongaya, who delivered the judgement, termed the interdiction as unlawful, saying that it violated the fundamental rights of the teacher. 

“The court finds that due process was not followed in terminating services of the claimant. Her employer ought to have allowed her a fair hearing before dismissal,” said Ongaya during the ruling.

In her petition, Watoro said the ‘rude’ dismissal she received earlier last year had adversely affected her life. She added that she never received a notice for impending termination of her services, and that she was denied fair hearing before being sacked. 

Justice Ongaya ordered the TSC to deploy her to Nakuru Day secondary school besides depositing the accumulated allowances she missed during her interdiction. 

The teacher was dismissed allegedly for non-compliance of an order by TSC directing her to report to a new workstation. She was also accused of insubordination to the school administration. 

The court also ordered the Ethics and Anti-Corruption Commission to launch immediate investigations into alleged violation of procurement laws at Nakuru Day secondary school. 

The procurement process was adversely mentioned in the case.
