The High Court has asked parties involved in students' suspension case to consult on whether the case would proceed after the school's lawyer told the court the students have already been admitted in other schools.

Sacho High School lawyer Steve Biko who held brief on behalf of Prof Tom Ojienda said the students who were suspended have since moved and are admitted in other schools.

He said only one student would return to the institution to sit for his Kenya Certificate of Secondary Education (KCSE) examinations.

The school's principal Richard Moindi had on June said Lady Justice Abigael Mshila was biased in handling the case between the institution and parents of six students who had been suspended for indiscipline and the case was not heard.

The parents had filed a case at the High Court in Nakuru seeking readmission of the students whom the institution had told to attend classes from outside the school.

Judge Abigael Mshila ordered that the should school readmit the students but the school disobeyed the order forcing the court to detain the principal until he paid a bail of Sh750,000.

On Tuesday, High Court Judge Maureen Odero urged the parties to agree on whether to proceed with the suit on contempt hearing or not.

The case will be mentioned on October 9.
