The family of a 22-year-old man sentenced to life imprisonment on Wednesday by a Kisii court has filed an appeal terming the judgment as unfair.
The man was accused of defiling a minor
According to the suspect’s brother, Eric Nyamweya, their brother identified as Jared Nyamweya did not defile the minor as alleged by the plaintiff. The family termed the incident as planned.
Nyamweya was charged that on January 20, 2015 at Daraja Mbili, he defiled the minor in his house.
The court heard that the accused person lured the minor into his house by giving her sweets, after which he committed the offense. He allegedly warned the minor not to tell anyone about the ordeal.
The court heard that the girl bled for three consecutive days after the act, prompting the mother to take the girl to Kisii Level Five Hospital where a doctor examined the girl and confirmed that she had been defiled.
The accused was later arrested and arraigned in court.
He, however, denied the charges before Kisii Senior Principal Magistrate Lucas Gwaro.
In his ruling, Justice Gwaro said the prosecution had proven beyond doubt that the accused indeed committed the offence.
