A High Court judge who was to hear a murder case involving a former Maralal OCS on Thursday disqualified herself from further hearing of the case.

Lady Justice Maureen Odero said that she would no longer handle the case because of personal reasons and referred the case to Judge Antony Ndung'u.

Patrick Wafula, a former Maralal OCS is accused of killing a Laikipia University-Samburu Campus student, Tom Rono on October 3, 2013 in Maralal.

Rono, alias Thompson Rono was among a crowd that had gone to the Maralal Police Station to identify animals that had been recovered after a raid. He was shot by a stray bullet and died on the spot.

The office of the Director of Public Prosecution, Keriako Tobiko and the Independent Police Oversight Authority conducted investigations and ordered Wafula be charged with murder.

On July 21, 2015, Wafula denied the charges before Lady Justice Odero and was released on Sh500,000 bond.

State prosecutor Nelly Ngovi told the court that the prosecution had seven witnesses present in court to testify.

Justice Ndung'u directed that the case will be heard before him on February 16 and 23, 2016.
