A member of the Nakuru County Assembly accused of malicious damage was released on a Sh200,000 cash bail by a Nakuru court on Friday.
London MCA, Francis Njoroge jointly with others is accused of willingly and unlawfully destroying a perimeter wall valued at Sh10,000,000, a property of Beyond Housing Co-operative Society at London Estate on August 23 In Nakuru County.
According to police records, Njoroge together with others allegedly went to the piece of land located near Kobil petrol station and demolished the perimeter wall. The police also say that he was in the company of young men armed with bows and arrows and chased away the guards.
The complainant, John Oyunge went to the scene and later informed the police about the incident.
On August 26, the MCA presented himself at Kiamunyi Police Station where he was escorted to Central Police Station and released on Sh10,000 cash bail.
State prosecutor Cosmas Kunyua also told the court that the accused went to the police station and threatened the OCPD Bernard Kioko and therefore urged the court to remand him to allow further investigations.
Njoroge’s Lawyer Hari Gakinya objected the claims by the prosecution to remand his client saying that he reported voluntarily to the police station. Gakinya also said that his client has a constitutional right to be granted bail adding that he is an MCA in Nakuru County.
Appearing before Principle Magistrate Wakumile Ndururu, he pleaded innocent and the court said that there was no compelling reason to deny him bail.
He was released on surety bond of Sh2 million and an alternative cash bail of Sh200,000.
The case will be heard on October 5.
