A young man was set free on Friday by Nakuru court over unavailability of witnesses to testify on robbery with violence case. Paul Nganga allegedly robbed Joseph Koech Sh 520 while armed with offensive weapon on February 4, 2014 in Njoro Sub-County.
Police launched a man hunt for Nganga and he was arrested on March 3 and taken to Njoro police station. According to the medical report, Koech was taken to Njoro Health Centre on February 5 and received treatment for his injuries.
Five witnesses later recorded their statements at Njoro police station but have not been appeared in court. Nganga was faced with robbery with violent charges since last year but the case didn’t proceed due to failure of the witnesses to avail them in court.
Chief Inspector, Sirorei Rop said that Njoro police had written to the office of prosecution requesting to withdraw the charges against Nganga. “The Investigating officer has written the office of the prosecutor to withdraw the case against the accused, this is because there have been difficulties tracing the whereabouts of the witnesses,” Sirorei added.
Chief Magistrate, Joel Ngeno told Nganga that the court has dropped the case but he can be charged again if he committed another offense
