A middle aged man has appeared before a Nakuru court for allegedly defiling and infecting a 13 year old girl with HIV .

The court heard that, the accused, Raphael Mbugua who is a shopkeeper at Naishi Trading centre in Njoro District lured the minor who had been sent by the mother to buy sugar, to enter into his shop and eventually committed the beastly act.

“Mbugua told me to enter into his shop when I did so he stripped me naked and defiled me,” said the minor.

The minor told the court that the accused person threated to kill her if she dared told anyone about the incident.

The minor while testifying before Resident Magistrate Eunice Kelly said that she came to discover that she was infected with the virus after the father who was suffering from Tuberculosis was asked by a doctor in a Chinese clinic at Naishi trading centre to bring the entire family for diagnosis to determine if they were infected with TB.

“I discovered that I was HIV positive when the doctors examined me and immediately they enrolled me on the ARVs program,” said the minor.

When she was tested she turned out to be HIV positive while the rest of the family tested negative, on interrogation by the mother she revealed that the accused person had lured her and consequently committing an indecent act and defiling her.

The accused and the minor were taken by the investigation officer to Nakuru provincial hospital for medical examination where they both tested positive.

The court had been told that on December 26th last year at Naishi trading centre in Njoro district within Nakuru county the accused intentionally and unlawfully committed an indecent act, defiled and infected the minor with HIV.

Mbugua had denied the charges and has since been in custody.

The hearing will be on December 7th this year.
