A middle-aged man was on Thursday sentenced to 20 years imprisonment by a Kisii court after he was found guilty of defiling a minor.

Collins Bina, who appeared before chief magistrate Patricia Wanyama, was charged that on September 2, 2015 at Eramba village in Kitutu Chache North sub-county, he had a sexual intercourse with a 13-year-old girl.

The court heard that on the material day, the girl was passing by near the house of the accused who later called her alleging that he had information from her parents to relay to her.

The prosecutor, Hellen Monyangi, said the accused grabbed the girl and locked her up in his house where he defiled her severally.

The girl was later saved by the neighbours who heard her shouting and screaming in the accused’s house.

The prosecutor told the court to treat accused person as first offender.

In mitigation, the accused pleaded guilty to charge and asked the court for leniency, saying he has a family to take care of.

The chief magistrate, however, said the evidence adduced before the court were clear without undoubtable reason hence the offender deserved a deterrent sentence. 

The magistrate gave him 14 days right of appeal.
