A 45-year-old man was sentenced to two years in jail on Monday by a Nakuru court for obtaining money by false pretense and forgery.
Isaac Kinyanjui Mugu alias John Wanyoike alias David Mwangi was accused alongside Joseph Njuguna and others not before the court, of intending to defraud Jared Mungare a sum of Sh300,000 by falsely pretending he was in a position to sell him a piece of land in Njoro on September 5, 2012 with in Nakuru town.
Senior Resident Magistrate Judicaster Nthuku said that the accused admitted to receiving Sh300,000 from Mungare during a cross-examination and the agreement of a land sale was finalised in the presence of an advocate.
Kinyanjui faced alternative charges of forgery and altering a document (a title deed) on March 3, 2011, within Nakuru Town.
Njuguna was acquitted by the court on grounds that he was barely a broker and he got paid Sh20,000 in the land deal, as he had claimed that he did not know that Kinyajui had deceived in the land sale.
Nthuku said that his presence in the deal had an agreement between the two parties and he did not contribute in defrauding the complainant.
She said that the prosecution had failed to prove that the Njuguna obtained the document, title deed by false pretense, he was therefore acquitted.
In his mitigation, Kinyanjui told the court that he is a father of eight and a bread winner of his family. He also told the court that he has hypertension and urged the court to consider his 'failing' health when sentencing him.
The court found Kinyajui guilty in two accounts: forgery and altering a title deed and therefore, sentenced him to two years each under section 215 of criminal procedure code, he will serve them concurrently.
