Three daughters of a Nakuru Tycoon involved in a legal tussle with other family members will continue occupying apartments which are part of a Sh50 billion estate after the court extended orders barring their eviction.
The High Court in Nakuru had granted the three daughters of the late billionaire Stephen Kung'u orders restraining his first wife , Grace Nyambura from evicting them from the apartments in Hurlingam.
Lady Justice Janet Mulwa had issued the order when the deceased's daughters Rahab Wamacii, Naomi Wambui and Bilha Wanjiku from his second wife moved to court challenging their eviction.
In their affidavit, the three daughters had noted that they suffered a substantive loss after the deceased tycoon’s first wife successfully obtained orders in a Nairobi court granting her access to a revellers club known as Monte Carlos.
Their father passed on at his Pivot Hotel in Nakuru on April 6 following a deteriorating health record over several months.
This prompted the siblings to move to court claiming to be beneficiaries to his wealth after it emerged that his first wife together with her children planned to lock them out of the deceased's estate.
The three claimed there is a plot hatched to evict them from the apartments in Hurlingam after the step family managed to access Monte Carlo Club through a court order.
The deceased's property include the Parklands Villa, Luthuli House (Nairobi) among others and three apartment blocks at Hurlingham and Ojijo plaza (Nairobi) which attracts Sh 2 million rent a month.
The deceased also owned buildings in Parklands and Ngara (Nairobi) and vast parcels of land in Kiambu, Nakuru and Nyahururu among other properties.
The daughters have accused their step family of sidelining them in a bid to lock them out of the inheritance.
The matter was set for November 24 for inter-party hearing where both parties are to file and serve each other with written submissions.
