The Commission on Administrative Justice (CAJ) has gone to court on behalf of Lisa Wangari who was allegedly tortured by police to the extent of inserting bottles in her private parts.
CAJ went to court to pursue Sh7 million that Wangari was awarded in damages in 2010 but is yet to receive. The delay in issuing the compensation was despite following up on the matter severally.
The Treasury budgeted and authorised for the payment but the attorney general, who was sued on behalf of Parliament, and Mutea Iringo, the PS in the Ministry of Interior and Coordination of National Government have not made the payments.
The AG claims not to have received the money.
CAJ has filed a petition seeking orders to compel the AG and the PS to pay Lisa Wangari for damages amounting to Sh8 million which include accumulated interest.
The case will be heard on July 7 2014.
The CAJ, also known as the Office of the Ombudsman, is an independent commission established by the Commission on Administrative Justice Act, 2011 pursuant to Article 59 (4) of the Constitution of Kenya.
It is mandated to address all forms of maladministration, promote good governance and efficient service delivery in the public sector by enforcing the right to fair administrative action. The CAJ investigates abuse of power, manifest injustice and unlawful, oppressive, unfair or unresponsive official conduct.
