The lead lawyer in the case involving Neno Evangelism founder, Televangelist James Ng'ang'a on Wednesday withdrew from the case citing non-cooperation on the part of his client.
Mr Cliff Ombeta withdrew from the case after the Limuru Court which is handling the pastor's case declined to compel the pastor to issue samples of his blood for DNA tests to be carried out, as requested by the prosecution.
The withdrawal of Ombeta now means that Ng'ang'a will be represented by his other lawyer Asha Nyakundi.
"It has become increasingly impossible to continue representing my immediate former client because he has proved non-cooperative,” said Ombeta, while announcing his withdrawal from the case.
Dismissing the prosecution's request to have Ng'ang'a compelled to issue blood samples, Senior Resident Magistrate Timothy Ole Tanchu said that it would be akin to helping the prosecution in its case if it granted the request.
The prosecution has however promised to challenge the ruling adding that they also want the case to be referred to the High Court citing reservation in the manner in which the case is being handled.
Apostle Ng’ang’a is accused of allegedly causing an accident on Limuru-Nakuru highway on July 26 that led to the death of Mercy Njeri and left her husband with serious injuries.
The case will be mentioned on September 10.
