More than 100 squatters under the Beeston self-help group have lost an application where they sought possession of a parcel of land in Njoro.

The squatters wanted Amalgamated Sawmills, now Timsales Ltd, restrained from interfering with their possession of the land. 

In the application filed by Abau Kiguru and 96 others, Justice Roselyn Wendoh dismissed the application on grounds that it was defective and lacked merit.

The squatters had earlier lost a case in which they sought to have the respondent allocate a portion of the land to them. The squatters claimed that their parents, who were also employees of the then Amalgamated Sawmills, had stayed there for more than 10 years, thus gaining rights to own the land.

In her ruling, Justice Wendoh noted that the initial summons was filed by 97 people while the instant application was filed by 130 people. She said it was therefore not easy to tell the genuineness of the application.

She added that the 33 people who came later were not supposed to come into the case when it was already in the final stages.
