A woman was on Tuesday acquitted of forgery charges by a Nakuru court due to lack of of witnesses to testify.
Mercy Njoki was accused of allegedly using a fake thousand shilling note to pay for goods to cashier Stephen Kimani at Tawa supermarket in Bahati on June 23.
In June Njoki was arraigned in court before Senior Principle Magistrate Liz Gicheha where she pleaded not guilty. She was given a surety bond of Sh30, 000 and an alternative cash bail of Sh20,000.
She failed to raise the bond and was kept in custody pending hearing that was set for Tuesday.
Njoki allegedly tried to pay for the goods at the supermarket using her fake note which the cashier noticed, she denied and started to shout bringing the people to attention.
She was arrested and taken to Bahati police station.
State prosecutor, Hillary Songoyo told the court that the witnesses who were to testify against her were not before court.
Chief Magistrate, Doreen Mulekyo acquitted Njoki on grounds that there was no interest of the witnesses in attending court.
She acquitted Njoki under section 202 of the constitution.
