The Supreme Court has upheld the election of Gatundu North MP Wanjiku Wa Kibe.
The petition had been filed by the constituency’s former MP Clement Waibara, who argued that the 2017 polls were marred by massive irregularities.
This comes after the High Court in March 2018 nullified Kibe’s win, on grounds that the process was not free and fair.
The decision was however overturned by the Court of Appeal in July after a three-judge bench ruled that the High Court erred in nullifying the former MCA's election.
In its ruling on Friday, January 18, 2019, the Supreme Court noted that Kibe had been validly elected, with the judges arguing that the irregularities in the polls did not justify a nullification.
Her Marakwet East counterpart Kangongo Bowen also had his election upheld, following a petition by a resident in the constituency, Mr Sammy Kipkeu.
Others who survived their election petitions include Embakasi East MP Babu Owino, Lamu Senator Anuar Loitiptip, Eldama Ravine MP Moses Lessonet and Luanda's Christopher Omulele.
Ahmed Kolosh of Wajir West was however dealt a blow after the Supreme nullified his win and called for fresh polls.
