The Court of Appeal has upheld Gatundu North MP Wanjiku Kibe's election in last year's general election.
The Appellate Court on Tuesday reversed an earlier ruling by the Kiambu High Court that had nullified Kibe's election on grounds that it was not free and fair.
In their ruling, Court of Appeal Judges Roselyne Nambuye, Agnes Murgor and Gatembu Kairu ruled that the High court erred in nullifying Kibe's election.
The judges argued that the High Court had nullified the election on technical errors.
The three judges said that the anomalies in the election were administrative issues that did not warrant the nullification of the election.
They took issue with the High Court decision to order for an audit of the election results yet no party had made the request.
The Appellate Court ruled that Kibe was validly elected as Gatundu North MP in the 2017 polls.
In April, a Kiambu High Court nullified Kibe's election citing serious illegalities and irregularities. The court had ordered for repeat elections.
However, Kibe filed an appeal challenging the ruling on grounds that the High Court was not fair in its hearing and ruling.
The MP has since welcomed the Court of Appeal ruling, saying that her agenda is to continue serving Gatundu North people.
"The court of appeal has upheld the decision Gatundu North people made on August 8, 2017," she told journalists at the Court of Appeal in Nairobi on Tuesday.
The petitioner, former MP Kungu Waibara now says he will move to the Supreme Court to appeal the Appellate court ruling.
