Irene Nyakerario, the chairperson of famous 'Daughters of Raila' lobby group, will still battle in court despite Thursday's victory.
Nyamira High Court Judge Esther Maina upheld Magistrate Court ruling that reinstated her to Nyamira Assembly.
But Damaris Mouni, who had claimed the MCA slot nomination, stood her ground when she appealed the ruling.
"I am sure she knows that she will lose again. However, she is just buying time.
"Although it's her right, she just wants to frustrate by by continued earning of salaries and allowances," she said.
Mrs. Mouni reportedly had her name sneaked to ODM list by her son, Gekara Mouni, a former IEBC employee.
Lawyer Wilkins Ochoki says the notice of appeal will still grant Ms. Mouni MCA privileges.
"Even though she is still buying time, the appeal notice acts as stay order. She still has a right to explore all channels," he said.
ODM party through Secretary General Edwin Sifuna has threatened to whip Mouni over her persistent court battle.
