This is after the High Court referred the matter to Chief Justice David Maraga, who now seeks to set up a judge-bench to hear the petition.

High Court judge Justice Eric Ogola on Tuesday, said the issues raised in the petition were weighty and of great public interest and so the case should have more than three judges to hear and issue a ruling.

The county government of Mombasa will take over management and operations of the port, in case Maraga's bench rules infavour of the petition which was filed by Asha Omar, Gerald Kiti, and William Ramogi, through lawyer Nyambura Kihoro.

They sued the Kenya Ports Authority, Kenya Railways Corporation, the Attorney-General, and the Cabinet Secretary in charge of Transport and Infrastructure.
