City lawyer Nelson Havi has scolded Office of the Director of Public Prosecution for allegedly spreading falsehoods on what transpired on Thursday in court during the proceedings of the case involving DCJ Philomena Mwilu and the state.
In a tweet, ODPP claimed that a five bench judge had reprimanded the outspoken lawyer for allegedly escalating onslaught against the DPP Noordin Haji on Twitter.
"Court reprimands lawyer Nelson Havi for attacking the DPP on social media without facts or evidence. The 5-Judge Bench reprimanded Havi for accusing DPP of paying bloggers to spread false information about DCJ Philomena Mwilu," ODPP tweeted.
Mr Havi is among a platoon of lawyers fighting to block prosecution of Justice Mwilu who is facing criminal case. She's accused of obtaining loans from Imperial Bank without repaying this causing it's liquidation.
But in a series of tweets, Havi accused the ODPP of spreading falsehoods on social media, adding that such a request by the prosecutors were denied by the court. He also averred that the Twitter account in question belongs to the public.
"Your request to the Court was intended to coerce me to withdraw my tweets. The Court rejected your request. Stop spreading propaganda, the world is alive to it," he argued.
"Do you understand that your Twitter handle is that of an office created under the Constitution? One which should serve the public? One sustained by public funds? We will continue calling you out whenever you adopt underhand unethical tactics," he added.
The five judges are expected to make a ruling on Mwilu's case on May this year. Defense team expects allegations facing her to be categorised as civil thus need for her to face JSC.
