Former Kathiani MP Wavinya Ndeti has maintained that she won the Machakos gubernatorial election in 2017 but her victory was allegedly stolen.

Ndeti through his lawyer Ahmednasir Abdullahi told the Supreme Court Judges led by Chief Justice David Maraga that the Independent Electoral and Boundaries Commission (IEBC) and Governor Alfred Mutua colluded to rig his client, Ndeti out.

In her submissions in an appeal filed by Mutua challenging the Court of Appeal's decision that nullified the election, Ndeti alleges that IEBC cooked up results by using a different form 37 C to declare the results.

Ndeti further claims that the Machakos gubernatorial election was marred with malpractices orchestrated to deny her victory.

“My client pleads with this honorable court to uphold the court of appeal judgment that nullified the Machakos gubernatorial election,” Ahmednasir told the court.

He said Machakos residents don’t have a governor as at now and that they should be given another opportunity to go  back to the ballot and fairly elect their governor.

On June 8, the appellant court nullified Mutua’s election on grounds that it was not free and fair.

The court then directed IBEC to conduct a fresh gubernatorial election.

Mutua, however, rushed to the Supreme Court and filed an appeal challenging the ruling.

Mutua and Ndeti are not seeing eye to eye politically and have been engaging in political squabbles.

The Supreme Court will fix and announce a date for the appeal case ruling.
