The Ethics and Anti-Corruption Commission (EACC) now wants Kiambu Principal Magistrate Brian Khaemba investigated for breaking his sick leave to grant embattled Kiambu County Governor Ferdinand Waititu anticipatory bail.
In a letter written to the Judicial Service Commission (JSC) on Wednesday, the EACC wants the magistrate probed on grounds of conflict of interest.
The EACC claims they have received credible information indicating that the magistrate broke his sick off to grant Waititu anticipatory bail.
"The fact that of the Hon Magistrate having to break his sick off, if indeed true, to come to attend to a specific matter, when there were other judicial officers, who would have handled the matter may be an indicator that the Hon Magistrate had an interest," EACC's letter to the JSC read in part.
Governor Waititu faces charges pressed by the anti-graft body of embezzlement of county funds, charges that he has strongly rejected, saying that they are based on baseless allegations made by his political adversaries.
Twalib Mbarak, the EACC boss, confirmed that the letter had been sent to the JSC.
"We have written a protest letter to the Judicial Service Commission. I have just signed a letter to complain about that particular case," Mbarak said.
The anticipatory bail is aimed at shielding Governor Waititu from arrest.
