A court sitting in Mombasa on Thursday jailed Changamwe MP Omar Mwinyi for four years.
Chief Magistrate Evans Makori ruled that there was evidence to link the MP to assault that saw two police officers injured in April 2017 during ODM primaries.
"Having carefully considered the evidence by the prosecution, I find the accused guilty as charged.
"It is clear the accused failed to restrain or stop his supporters from disrupting the polls therefore he is deemed to have participated in the fracas," he said.
However, the court dropped seven other charges including obstructing election officers and interfering with campaign material.
The officers were providing securing during the chaotic ODM primaries.
Alternatively, Omar maybe allowed to pay a fine of Sh1 million of serve the sentence, something that can make him lose his seat.
