This comes after DPP Haji unleashed top legal minds on the case to prosecute it.

Milimani High Court Judge Jessie Lessit on Monday remanded the ODM governor pending the hearing of his bail application on Tuesday.

Obado’s lawyers had requested the court to remand him at the Gigiri police station.

However, the prosecution opposed the application, saying that he cannot be remanded at a police station.

The Criminal Procedures Act states once a suspect has taken plea he or she is no longer in the hands of the police.

“The suspect (Obado) is now an accused person and is no longer in the hands of the police but the prisons department,” Deputy Director of Public Prosecutions Jacob Ondari said in an exclusive interview.

Ondari observes that all accused persons are handed to the prisons department once they plead guilty or not.

Obado was arrested on Friday last week and detained at Gigiri police station.

He will not spend another night in remand pending his appearance in court on Tuesday.

The Director of Public Prosecutions Noordin Haji has since asked the police to hunt down and arrest all people adversely mentioned in Sharon Otieno's brutal murder.
