Deputy Chief Justice Philomena Mwilu was ambushed out of a JSC meeting before being arrested by detectives, of of the commissioners has revealed.
In an interview with KTN, Prof Tom Ojienda, who represents LSK, said DPP Noordin Haji and DCI George Kinoti stormed into a meeting chaired bay David Maraga and demanded to see him.
"They went down for the meeting and then requested the DCJ to attend. We knew it was a formal meeting and so we had to hold on a bit. We learnt they had a long session with the DCJ and she would later be arrested.”
Prof Ojienda added; “Unknown to us that an arrest would occur in the course of the day. I must say that I have never heard of an arrests taking place within the precincts court. And we had not before then discussed the factual underpinnings on the case touching the case.”
The two top detectives had summoned Maraga to inform him of the charges facing his deputy from a Judicial Service Commission meeting.
And later, Mwilu would be asked to join the meeting where her fate was sealed before being bundled to DCI headquarters.
She is being accused of tax evasion, abuse of office and role in collapsing of Imperial Bank through fraudulent transactions.
But Ojienda believes that the second most powerful judge would have been subjected to JSC for probe.
“In my view the issues in question; we have a process and we often have jurisdiction over question touching misconduct of judges and other conduct under article 168 of the constitution that will lead to removal from office, we would have expected that if the issues touched on incompetence or misconduct that would have been referred to JSC.”
High Court stopped criminal proceedings against her until a petition challenging constitutionalism of the matter is handled.
