A 42-year old Nakuru woman charged with intentionally infecting her neighbour's nine-month-old baby with HIV is set to appeal a court order directing her to get tested for the virus.
It is alleged that the incident took place on September 18, 2018 at Gichobo area in Njoro sub-county.
The woman who was ordered on October 18, 2019 to provide samples of her blood for testing, on Friday revealed plans to challenge the order.
Lawyer Jenifer Mugweru, representing the accused requested for documents of the court proceedings on behalf of her client.
“The defense intends to file an application for review of the orders. It is in interest of justice that we be provided with all documents including the orders and trial proceedings,” Ms Mugweru said as quoted by Nation.
The defense was granted their request by the court.
The prosecution in a previous court session argued that they needed the woman's HIV test results, as a way of finding out whether she committed the crime or not.
She was accused of breastfeeding a baby who had been left in her custody, with the knowledge of the fact that she was HIV positive.
The accused was, however, released on a bond of Sh50,000. The case will resume on December 12, 2019.
