The Director of Public Prosecution (DPP) Noordin Haji has released 21 petty offenders from the Hindi prison in Lamu.
The DPP said his office handled 141 cases during the week-long All for Justice service across Lamu. Attorney General Paul Kariuki oversaw the release of the offenders.
The DPP said that charges against the 21 could not be sustained in court.
"We have reviewed a total of 141 cases which represents 47 per cent of the total cases and recommended various measures on each case," Haji said.
Haji said his office is releasing petty offenders as one of the measures to help decongest the prisons across the country.
He also argues that petty offenders are being freed to create room for 'bigfish' and 'whales' in war against graft.
The DPP, however, cautioned the freed suspects, saying they will be re-arrested if they commit offences.
Haji says plea bargain is one of the tactics he is using to fight crime and graft.
The DPP alongside players in the judicial sector has been in Lamu county for the past one week where he held community dialogue with the residents.
