Lawyer Alutalala Mukhwana has advised Director of Public Prosecutions (DPP) Noordin Haji to handle the ongoing case against Deputy Chief Justice Philomena Mwilu with great caution.

Haji on Tuesday approved the arrest of Mwilu over graft allegations, after which the second highest judge in the nation was arrested, arraigned and later released on a 5 million shillings bond.

In an interview on Citizen Television on Tuesday night, Mukhwana cautioned that the proceedings against the Supreme Court's Second-in-Command might end up harming the presidency.

He said that the allegations on Mwilu will be translated to be the realisation of Uhuru’s ‘We shall revisit’ threat when the Supreme Court annulled his August 8, 2017, reelection.

‘’Haji better be right on this one because we do not operate on a constitutional vacuum. If the case goes wrong, then it will be taken that he is helping in realising the threat,’’ noted Mukhwana.

He further noted that just like the constitutional spells, Mwilu is not to be branded a criminal yet as she remains innocent until proven otherwise.

‘’The allegations placed on her are outright criminal but remain mere allegations until proven,’’ he added.

Mwilu is accused of among others evading taxes and receiving 12 million shillings from the collapsed Imperial Bank in cash gift, contrary to the judiciary principles.
