The Office of Director of Public Prosecutions (DPP) now wants the court to hand death sentence to three out of the four suspects charged with terrorism counts in relation to the 2015 Garissa University terror attack.
On Wednesday, Milimani Chief Magistrate Francis Andayi found the three; Mohamed Abdikar, Hassan Edin Hassan and Hassan Rashid Mberesero guilty of 156 terror charges.
In his ruling, the Magistrate said the prosecution proved its case against the three, adding that evidence tabled clearly indicated that they were the masterminds of the attack that left 147 people, mostly students dead and scores injured.
Andayi in his ruling noted that the three were in communication with the planners of the attack and even knew of the plot to attack the university.
“I am satisfied that the accused persons were members of Al-Shaabab and they knew of the plot and were also part of the attackers,” he ruled.
The Magistrate, however, freed Sahal Diriye Hussein, noting that the prosecution failed to prove a prima-facie case against him.
The DPP in his submission through Counsel Carol Sigei recommended maximum sentence for the convicts, noting that justice can only be served if they are maximally punished for the crimes they committed.
The three convicts will be sentenced on July 3.
