Former presidential candidate and human rights activist Nazlin Umar has hit out at the Director of Public Prosecutions Noordin Haji after he allegedly dropped charges against eight suspects in the NYS season II case for lack of evidence.

Umar claims that DPP Haji is slowly letting himself down, noting that the suspects should not have been charged if there was no evidence against them.

According to Umar, the DPP must be firm in the fight against graft or the ‘Wanjiku’ will lose faith in him.

“It is not logical for people to be taken through court and later acquitted or charges against them dropped for lack of evidence,” Umar said.

Umar stated that the war on graft and impunity must not favour anyone.

“DPP Haji should ensure that the cases he is approving to go to court have strong evidence to avoid embarrassing himself and Kenyans,” she said.

The former presidential candidate also cautioned DPP Haji against taking instructions from any quarters on who to take to court and not to take to court.

The DPP has often stated that his office is independent and does not take instructions from anyone.

Mr Haji has often said that his office makes independent decisions on whether to prosecute or not based on evidence provided.

In the recent months since he took over the helm of ODPP, Haji has taken prominent government officials to court over graft cases.

On Monday, the DPP, however, said that his office has dropped charges against eight NYS II suspects for lack of evidence.

The DPP said that out of the eight suspects, four have agreed to be state or prosecution witnesses in the trial.
