Embakasi North MP James Mwangi Gakuya and eight (8) other officials of the Constituency Development Fund (CDF) have been charged in court with mismanagement and embezzlement of the constituency funds amounting to Sh 39, 850,049.
The MP alongside his co-accused persons who were arraigned before Milimani Anti-Corruption Magistrate Felix Komba on Thursday, were also charged with fraudulent acquisition of public property, conflict of interest, willful failure to comply with procurement laws, conspiracy to defraud the government and failure to adhere to procurement and disposal laws.
They are accused of committing the offenses between March 27 and September 5, 2015 in Embakasi North.
The MP and the other accused persons however pleaded not guilty to the charges.
The prosecution, led by Prosecution Counsel Victor Owiti opposed the accused person’s application to be released on bond or bail.
The prosecution argued that the charges facing the accused persons are serious.
The prosecution also told court that the accused persons could interfere with witnesses if released on bond or bail.
