The High Court in Nairobi has allowed a case challenging the authenticity of Taita Taveta Governor Granton Samboja's academic credentials to resume.
This is after the Ethics and Anti-Corruption Commission (EACC) through its lawyer Jackie Kibogy moved to court once again, seeking to have a lost file reconstructed, for the case to resume.
The first time governor who was elected through NASA coalition's Wiper Democratic Movement - Kenya, allegedly forged a university certificate which he used to contest in the August 8, 2017, general elections, sending home his predecessor, John Mruttu.
On Wednesday, Kibogy said the file could not be traced in the court registry for 60 days and maintained that Samboja forged the certificate from the Kenyatta University to be elected.
The governor has been named as the first respondent while the Independent Electoral and Boundaries Commission (EACC) is the second respondent.
The case will be heard on October 9, 2018.
In January, the High Court in Voi threw out a petition challenging Samboja's win that was filed by two voters Armstrong Kiwoi and Johnson Nyambu.
The had questioned Samboja’s degree, terming it fake.
However, Justice Eric Ogola dismissed the case, saying the court did not have the capacity to ascertain the validity of Samboja’s degree certificate and directed EACC and the office of the Director of Public Prosecutions to proceed with an integrity case that sought to challenge the Samboja’s academic credentials.
